Getting Permission: How To Legally Use Other People’s Intellectual Property

Hey, Legacy Builders! Welcome to the first lesson of the OPIP, Other People’s Intellectual Property chapter of the IP for Business Blueprint Course. I’m Jenn McNeely with JWM Designs and Marketing, and in this video lesson, I’m going to talk about the ways you can get permission to use other people’s intellectual property through a release. In a prior lesson, I discussed getting a transfer of rights via a license agreement or an assignment of rights. In this lesson, we talk about different methods of permission releases.

It’s inevitable that you will use other people’s intellectual property in your business. Whether it’s software, photographs, designs, or imagery, you are going to use protected materials in your business. Getting permission to use protected materials on the front end will reduce the levels of stress and anxiety you will experience for failing to do so. Unfortunately, far too many individuals and business owners use the intellectual property of others without permission, either because they’re unaware of the parameters of using protected materials or they just do so intentionally. There is a popular saying that “ignorance of the law is no excuse.” Whether you infringe on another person’s intellectual property on purpose or accidentally, you can be liable for damages just the same. Because intellectual property rights can only be enforced by the owner, if the owner is unaware of the infringing activity, the infringer will continue to use the work without permission. But who wants to run a business looking over their shoulder, hoping to never be discovered? With that being said, watch the video to learn about the ways you can get permission to use protected works through a release.

This may mean that companies like [insert low-cost company name here] will undercut me with lower prices, but I’m okay with that. Often times their fees eventually surpass mine once you add in all the elements that I provide wholesale.

Growing your online presence from scratch takes time but when done correctly will generate great returns. I am a firm believer in transparency with my clients and want them to truly understand what it means to work with me. So, here’s to trusting the process and taking client’s businesses to the next level.
